The current scenario entails a breach of time, which is generally of the essence. It is arguable that this breach is one of condition, and the immediate consequence of that for Peter is his right to elect one of two alternatives; terminate the performance of or affirm the contract, communication either of them in a reasonable amount of time (Stocznia Gdanska SA v. Latvian Shipping Company (2002)). Since Peter has opted to stay at the house and continue running it as a guest house, he has decided to opt for the affirmation of the contract, which will be affected just by merely continuing with his obligations of running the business while maintaining a healthy profit (Davenport v. R (1877)). Thus, Peter is advised to affirm the contract and apply for an order of specific performance by exercising his right of election and issue a claim in damages.

Comparing Costa and Starbucks One of the biggest and fastest growing industries today is the coffee industry. This industry basically includes individual cafes, hotel cafes and retail chains. In this study, we shall be focusing on the Retail Chains that belongs to the organized sector. The retail outlets share a particular brand and have similar kind of management, with standardized business procedures and practices. The major players today covering market share all over the world are Starbucks Coffee, Barista Coffee, Cafà © Coffee Day, Costa Coffee, etc. For this study, the two retailers Starbucks Coffee and Costa Coffee are chosen because of their identical pattern of functioning and growth. They are the two major players in the coffee cafà © industry, and their customers consider them both as interchangeable brands. That is why it is important to study how these brands differentiate themselves from each other, and attempt to improve brand loyalty amongst the customers. Objectives of the Study By conducting a comparative study of Starbucks Coffee and Costa Coffee, we shall study why one retailer is more successful than the other, and how the performance of these retailers can be improved. Studying the characteristics, history, performance and marketing strategies adopted by both the companies, and the customers perception about the two is the centre point of this research. The objectives of the study can be summarized as below: To compare and study the 4Ps, namely Product, Price, Promotion and Place, of Starbucks Coffee and Costa Coffee. Conclusion Our survey made us reach the conclusion that both, Costa Coffee and Starbucks Coffee, enjoys equal customer preference. Although price and promotional schemes influence the decision of the people, but the taste of coffee is a very important factor in deciding the store to visit. Costa coffee has a unique taste which attracts the customers. Moreover, people love to sit in the excellent ambience provided by Costa coffee. Fate in Shakespeares King Lear :: King Lear essays
Fate in King Lear "There's a divinity that shapes our ends, rough hew them how we will." These words from Hamlet are echoed, even more pessimistically, in Shakespeare's play, The Tragedy of King Lear where Gloucester says: "Like flies to wanton boys, are we to the gods, they kill us for their sport". In Lear, the characters are subjected to the various tragedies of life over and over again. An abundance of cyclic imagery in Lear shows that good people are abused and wronged regardless of their own noble deeds or intentions. Strapped to a wheel of fire, humans suffer and endure, prosper and decline, their very existence imaged as a voyage out and a return. The movement from childhood to age and back again, the many references to fortune whose wheel spins humans downward even as it lifts, the abundance of natural cycles which are seen as controlling experience, even perhaps the movement of play itself from order to chaos to restoration of order to division again. Throughout the text, the movements of celestial bodies are used to account for human action and misfortune. Just as the stars in their courses are fixed in the skies, so do the characters view their lives as caught in a pattern they have no power to change. Lear sets the play in motion in banishing Cordelia when he swears "by all the operation of the orbs from whom we exist and cease to be" that his decision "shall not be revoked". How like the scene in Julius Caesar wherein Caesar says "For I am constant as the Northern star" Lear vows to be resolute but dies regretting his decision at the hands of his daughters who claim love him "more than word can wield" and are "alone felicitate" in his presence. That Edmund disbelieves in the influence of the stars adds to the play's recurring theme that part of our fate is our character; that we choose our lot in life by how we choose to act. Similarly, in Lear Gloucester's feelings predict what is to come when he says "These late eclipses of the sun and moon portend no good..." And because of this Gloucester begins to envision a world where "Love cools, friendship falls off, brothers divide..." While his father misunderstands the importance of the celestial bodies, his bastard son, Edmund denies the importance of the movements of the heavenly bodies. He calls it "an excellent foppery" to "make guilty of our disasters the sun, the moon and stars." (Just as in Julius Caesar we learn that "... The fault .

Hamlet & Ophelia
Throughout the play of Hamlet, one constantly questions if Hamlet is actually in love with Aphelia. His intentions are difficult to determine: it often appears as though he is not in love with her at all, but is in fact repulsed by her. Hamlet even insists that Aphelia leave him, and everyone else in her life, in his immortal line, ââ¬Å"Get thee to a nunnery' (Ill. L. Pl 25), thus sending her away to lead a life of solitude.However, despite these statements from Hamlet, his other actions give way to the idea that Hamlet not only loves Aphelia, but also cares for her so deeply that he sees her as a liability. He treats her terribly and insists that she leave him in order to protect her from being hurt or killed by his enemies. It is here that we see that, indeed, Hamlet really does love Aphelia. The closest that Hamlet ever comes to stating his love is in Act Ill. Hamlet says to Aphelia, ââ¬Å"l did love youâ⬠(Ill. L. Pl 25). However, he then goes on to tell her he does not l ove her.During this conversation, Hamlet believes someone may be eavesdropping on them. This is proven by Hamlet's question, ââ¬Å"Where's your father? (Ill. L. IPPP). Aphelia states that he is at home. Hamlet replies with, ââ¬Å"Let the doors be shut upon him that he may play the fool nowhere but in ââ¬Ës own houseâ⬠(Ill. L. IPPP-44). This quote suggests that Polonium, Aphelion's father, is eavesdropping on Hamlet and foreshadows that he may be planning something as a result. Hamlet would never want to give away his true intentions for Aphelia to one of his enemies, such as Polonium, and therefore lies to Aphelia about his intentions for her.His love for her is so deep that he is willing to make her believe that he does not love her in order to rote her. Another example of Hamlet admitting his love for Aphelia is in the letter that he sends her. Hamlet writes, ââ¬Å"Never doubt I love. â⬠(11. 11. IPPP). He tells her that among and between everything else around he r, his love for her is real. This is the one time before Aphelion's death that Hamlet reveals his true feelings. He feels he can do this in writing, as Hamlet believes only Aphelia will read the letter, as opposed to one of his enemies, such as Polonium.Hamlet knew he had to hide his love for Aphelia and act in a different manner to protect her. His plan backfires however when Aphelia chives the letter, as she gives it to her father. Not even in writing can Hamlet admit his true feelings for Aphelia without the information of his vulnerability slipping into the wrong hands. Throughout the play, Hamlet's love for Aphelia is questioned. Hamlet acts as if he does not love Aphelia in order to trick everyone else into thinking that he does not care about her. Hamlet does not want Aphelia to become involved with him because if Claudia decides to get revenge on Hamlet, she would die.Hamlet shows his love for Aphelia when he confesses to her that he ââ¬Å"lovedâ⬠her, when he sends he r the deter, and when he finds out that she has died. But many could argue that Hamlet never loved Aphelia ââ¬â that he fell out of love with her or he never loved her in the first place but was simply driven insane by his father's death and attempted to use her feelings for him to his advantage. Needless to say, there is concrete information pointing to Hamlet's love being true. Hamlet simply was not able to state it bluntly in order to protect Aphelia.Rexes Manchester Mr.. Hamlet's misogynistic feelings towards women come from his mother, Gertrude, and, unfortunately, Aphelia becomes part of his thoughts as well. Hamlet's mother is the cause for his suspicion towards women. Gertrude hasty, and incestuous, remarriage to Claudia, within a week of the kings death causes anguish, suffering and distress for Hamlet.This leads him to question the true heartiness of all women; ââ¬Å"O most wicked speed, to post with such dexterity to incestuous sheets! It is not nor it cannot come to good, but break, my heart, for I must hold my tongue. (1. 11. As a consequence, it seems, the misogynist that is Hamlet egging to break down. Which is why Aphelia is so important with in the story, she becomes a victim of Hamlet's anger that leads us to discover if he is truly a misogynist or not. It is Ap helia, the passive character in the relationship that has become the unlucky victim. Aphelia believed that Hamlet possessed real love for her, but so much to the point that he became ââ¬Å"mad for her love. (2:2:84) She accepted his love letters and acknowledged his indications. However, Hamlet becomes so concerned with how vengeful women are to men, or that they are a considerable threat to myself, and that he cannot stop for a moment and realize the pain he is causing Aphelia because of it. In the end, classifying Hamlet as a misogynist does not suffice to the difficult and realistic character of Hamlet. For, as it turns out, the feelings of hatred towards women were only because of the moments that he was caring and concerned with Aphelia and his mother.Though it is irresolute that he would have ever trusted a woman again but at the end he does reveal his love for Gertrude and Aphelia. Does Claudia murder his brother for his throne or his wife? Claudia is Hamlet's uncle, brother to king Hamlet. King Hamlet has been killed and a week after his death, Claudia became king and King Hamlet's wife, Gertrude, remarries to Claudia. The murder of King Hamlet is much like what we see in the Bible. Cain commits the first murder by killing his brother Able while he is sleeping peacefully in a garden.Much like this murder, Claudia murders his brother by pouring poison in his ear while he is sleeping in his own garden. Throughout the story Claudia' nerve is tested and finally he admits his ââ¬Å"offense is rank and smells to heaven because it hath the primal eldest curse upon, a brother's murderâ⬠(111. 11. 111). Claudia not only murdered King Hamlet for the throne but for his wife Gertrude as well. He always possessed the secondary role to his brother for quite sometime and because he was always second to King Hamlet, he became Jealous.The fact that King Hamlet was always busy in state affairs and fights could the reason for Gertrude loneliness, which brought her closer to Claudia. After the death of King Hamlet, support of Claudia gave Gertrude a way out to prevail over the situation and heartache. Weak moral strength in Gertrude made it simple for Claudia to convince her to marry him. After this it was simple for Claudia to have Gertrude become loyal to him, this also made him the father of Hamlet and brought his worries of revolt to a close as well as Hamlet's royal right to become king.As Claudia took over the throne and married his brother's wife, it also would make sense to say that he took over the throne so Hamlet would not be king. Also, Claudia had to ascend the throne nearly immediately since Denmark was on the brink of war with Norway. Two men a foot apart cannot see each other. A Ghost appears. Why has Shakespeare begun the play thus? What does it tell us about the nature of his audience? Shakespeare begins Hamlet in immediate suspense. There is no lighting and only two people on stage.The reason for this is to get the audience's attention from the beginning, without a strong introduction of the play the audience will be bored and unhappy with the performance. The audience at the globe theatre is rather uncivilized. Throughout the play itself the audience is drinking, eating and standing. Everyone in the audience is mostly dirtying, smelly and not very intellectual. If the actors were not performing at their highest level, things would be thrown on stage, the audience wou ld become irritated ND the situation would escalate very quickly to the point that there would be a riot.Shakespeare uses the tactic of introducing a ghost first because it conveys the overall setting of the play, which is suspense, mysteriousness, puzzlement and most of all, curiosity. Through this introduction there is no need for a narrator to come out on stage and say the play is beginning. Due to the mysteriousness the crowd becomes silent, as they are anxious to find out what the play is about. Without the beginning of the play starting as it does, there would be no way to have the audience cooperate for a long period of time.

Psychology Experiments/Biological Influences Essay
In this experiment, we aim to provide an understanding about the concepts of adaptation through a series of tests. This involves using our different senses to perceive changes in an environment, and how weââ¬â¢ll be able to adapt to these changes. à à à à à à à à à à à In the first experiment, the sense that we are going to use is the sense of taste. Through this test, weââ¬â¢ll determine how we adapt to changes in what we taste or basically what we eat. By mixing sugar into water, we create a sweet substance which weââ¬â¢re going to use for the taste test. We also need fresh water in order to tell any differences afterwards. What I did was to take a sip of sugar water and let it stay in my mouth for some time, until it tastes less sweet. It took several seconds until it tasted less sweet, and afterwards I took a sip from the cup containing fresh water. The surprising part was that the fresh water tasted doesnââ¬â¢t have any taste in it at all. I know water supposedly has no taste, but with the experiment, it tasted stale. à à à à à à à à à à à In the next test, the sense that will be used is our tactile sense, mainly the skinââ¬â¢s perception of temperature. Through this test, weââ¬â¢ll determine how we adopt to the changes of temperature in our environment. We prepare three bowls with tap water of varying temperature. One is hot (but not painfully so), another is very cold, and the other is a mixture of the hot and cold tap water. What I did was to submerge my left hand in the hot tap water and my right hand on the cold tap water. I let it stay there for three minutes, and afterwards I placed both my hands in the bowl containing the mixture of hot and cold tap water. I took not of what I felt in the experiment. à à à à à à à à à à à Upon placing my both my hands in the mixture of water, I noticed that my left (which was previously submerged on the hot one) felt cold until it slowly changes back to the temperature of the water mixture. Same goes for my right hand, which felt warm when I submerged it in the mixture until it slowly changed back to the temperature of the water mixture. The skinââ¬â¢s receptor was not able to perceive any changes in the temperature in the water. à à à à à à à à à à à The final test was again on the tactile sense, wherein we have to rub our index finger into a sand paper and rate its coarseness from 1 to 7, where 1 is very soft, and 7 is very coarse. When I rubbed my index finger to the sandpaper, my initial rating was that itââ¬â¢s 7, since I felt that it was very coarse to touch. When I rubbed my index finger on the sand paper for a second time, it felt a little different. Itââ¬â¢s as if it lost its coarseness a bit. Because of this, it would require a stronger stimulus in order to further activate it. Adaptation is defined as a positive characteristic of an organism that has been favoured by natural selection, since they are able to live successfully in an environment. On the first experiment on water sugar, there was a sour aftertaste when I sipped fresh water. This could be because sour taste neutralizes the sweet taste so when we sipped sugar water and swished it all over our mouth, we psychologically perceive that there is a sour taste in order to neutralize the sweet taste in our mouths. à à à à à à à à à à à On the second experiment on waters with different temperatures, we experience adaptation by being able to keep a constant body temperature. When we have our hands submerged in both hot and cold water and then submerge it to a mixture of cold and hot water. Our body tends to maintain a constant body temperature, so when it was from the hot water and then submerging it to the mixture, it would surely feel cold at first until we get used to the temperature. Same goes with the cold water, wherein when we submerge it to the mixture it would feel warm until it gets used to the temperature of the mixture. à à à à à à à à à à à On the third experiment, we experience adaptation at the tactile sensory level, wherein we tend to get used to the feel of the coarse sand paper, that when we rub at it again, it feels a little less coarse. This is adaptation in a sense that our body or our perception of the coarse texture of the sand paper is gradually being changed to a state wherein we wonââ¬â¢t feel uncomfortable in rubbing against it. As we feel that it is a little less coarse, then we are able to cope with its coarse texture. à à à à à à à à à à à We can associate this with the theory of adaptation by Lamarck, where organisms inherit the traits which are necessary for them to survive. Those who inherit this trait are able to continue to live, while those who donââ¬â¢t tend to perish. Because of this, the organisms who continue to exist are the ones who were able to get traits which would enable them to adapt to the world they live in. à à à à à à à à à à à In an evolutionary perspective, adaptation is really important because those who are able to adapt will be the ones to survive and continue to exist. This will result to organism who posses traits which are important for them to live in their environment. As the time continues to change the surroundings, only those who are able to cope with these changes will be the ones left to live.
